DAVIS, SHIEL AND KENDALL SENTENCED FOR 2ND DEGREE RAPE

On August 14, 2020, Larry Kendall, age 45, of Elkton, Maryland became the last of 3 co-Defendants to be sentenced for the crime of second-degree rape by the Honorable Beau H. Oglesby in the Worcester County Circuit Court.  Kendall, as well as co-Defendant Kyle Davis, age 22, also of Elkton, were both sentenced to serve 20 years in the Division of Correction.  The third co-Defendant, Damien Shiel, age 24 of Baltimore, was sentenced to serve 20 years in the Division of Correction with all but 15 years suspended by the Court.  All 3 men will be required to register as Tier III sex offenders for the rest of their lives.

The charges stem from a report of sexual assault made in August 2018 to the Ocean City Police Department’s Criminal Investigation Division.  The victim told investigators that she had been vacationing in Ocean City in June of 2017 with Kyle Davis, his uncle, Larry Kendall, and his friend Damien Shiel.  During the vacation, the 3 men acted together to overpower her in their shared hotel room and each of them forced her to engage in sexual acts with them against her will.  Investigators traveled across the state to interview witnesses and were able to corroborate the victim’s account by obtaining her medical records, Facebook messages between the victim and Shiel, and incriminating statements made by Shiel and Davis.

Worcester County State’s Attorney Kris Heiser thanked the Ocean City Police Department and Detective Perry for his excellent work, and commended Assistant State’s Attorney Karen Dean who prosecuted all 3 cases.  Heiser stated “The bravery of this young woman in reporting these offenses, combined with the relentless efforts of investigators and prosecutors to build a strong case has allowed us to hold these predators accountable.  We are proud to have secured the maximum allowable penalty due to our advocacy on behalf of the victim, and we will continue to work hard to obtain justice for every victim in every case.”
